AgNav Data Privacy Notice

This is your guide to how personal data is managed and protected by AgNav. Please read it carefully and should you have any queries in relation to how your personal data is dealt with, you may contact dpo@icbf.com.

AgNav is a collaboration between Bord Bia, Teagasc and ICBF (the Data Controllers) that aims to create a farmer-centric sustainability support framework which utilises the three agencies’ collective knowledge, data, support tools and other resources, to enable delivery against Climate Action Plan targets for the agri-sector. We take the protection of your personal data seriously. We want you to feel confident that we are keeping your personal data secure, and that we handle and process it in accordance with the European General Data Protection Regulation ((EU) 2016/679) and Data Protection Act 1988 to 2018. In our Data Privacy Notice we explain what personal data we collect, how we collect it, what we use your data for and how we safeguard it.

 

What personal data do we collect?

We want to give our farmers, advisors and all users the best possible experience. To do so, we need to collect personal data from you for certain processes such as providing a service and when you enquire about our services. “Personal Data” means data which relates to a living individual who is or can be identified either from the data in conjunction with other information that is in, or is likely to come into, the possession of the Data Controllers.

 

The personal data we collect includes:

  • Personal information such as name, address, email, phone, mobile and other contact information
  • For farmers we require your official farm identifier, such as herd number
  • When you visit our website, cookies on the AgNav website help us provide you a tailored service. Please refer to the cookies section within this Privacy Notice for more information on what cookies we use and how we use them
  • Data that we receive from Third Parties where you have given them permission to share your data with us in AgNav
  • When you contact us or give us feedback this may be used for training and operational compliance

    The Lawful basis

    Our lawful basis for collecting or using personal information to provide services is Contract.

     

    Where we collect personal data:

    We collect personal data when you sign our authorisation forms (e.g. ICBF authorisation form, Bord Bia Scheme application), when you sign up to access the AgNav service through another programme or scheme you are involved in, such as Teagasc Signpost Advisory Programme or a programme or scheme run by a food processor to which you have applied, or register for any of our apps, or visit our websites.

     

    How do we use the personal data you provide?

  • We use the data we collect and hold on our database to ensure we are providing you with highly relevant content and accurate information that meet your specific needs, and to deliver more efficient support to you in the area of farm sustainability
  • To accurately measure the sustainability metrics (e.g. greenhouse gas emissions) of a farm, synchronizing with the ICBF database to provide an accurate picture of the animals in a herd (where applicable), with the Bord Bia Quality Assurance Scheme databases (e.g. SDAS, SBLAS) to have accurate data on farm specific measures
  • To provide climate sustainability information to the Irish agriculture sector on an aggregate level
  • To help us refine the accuracy and quality of the AgNav service
  • To make sure we are only sending you communications about services that you have shown an interest in using
  • To keep you updated on any changes to the service, and to advise you on how you can get the best out of the AgNav service
  • To meet our legal and regulatory requirements
  • In many cases we aggregate and/or pseudonymise your personal information so that it no longer identifies a particular individual

    Who do we share your personal data with and why?

    There are a number of reasons why we would share your personal data with third parties. Be assured we always look to safeguard your data to the highest possible standards and in line with best practice.

    Here is a list of instances in which we share your data, and the third parties to whom we share it with:

  • Organisations to whom you have authorised access to your data
  • Organisations with whom you are participating in a particular scheme or programme that requires access your data on AgNav
  • Organisations that work on behalf of the AgNav partners to provide an efficient service, such Data Processors or ICT Service Providers
  • If we are required by any relevant public authority or law enforcement agency under legal obligations

    How long do we keep your personal data?

    Personal data will be retained for three years based on the requirements of maintaining data usability should the user wish to return to the scheme.

    If the farmer does not retain membership to a sustainability programme and/or does not retain membership to the Bord Bia Sustainable Assurance schemes we will retain personal data for three years from the time they leave AgNav and/or any associated programme to facilitate re-accessing the data if they re-join.

     

    How we secure your personal data?

    Securing your personal data is extremely important to us, which is why we take appropriate measures to protect your data. We use a range of security technologies and processes, and actively monitor emerging cyber threats on a 24 x 7 basis. We regularly audit our systems and processes.

     

    Data Protection Principles

    The Data Protection Requirements require personal data to be processed in accordance with certain principles which require such data to be:

  • Obtained and processed fairly and lawfully;
  • Kept only for one or more specified and lawful purposes;
  • Kept safe and secure;
  • Kept accurate and up to date;
  • Adequate, relevant and not excessive;
  • Not retained for longer than is necessary for the specified purpose or the purposes;
  • Given to an individual, on request.

    Privacy-by-design and by Privacy-by-default

    We ensure that privacy is built into the AgNav system by design and default to guide the development of the system. We will conduct a review of our Data Protection Impact Assessment document for all new features and services, together with an analysis of any associated data processing activity.

     

    What rights do you have?

    As a data subject, you have the following rights under Data Protection legislation, and we as Data Controllers in respect of your personal data, will comply with such rights in respect of your personal data.

  • The right of access personal data relating to you;
  • The right to correct any mistakes in your personal data;
  • The right to ask us to stop contacting you with direct marketing;
  • Rights in relation to automated decision taking (it should be noted that this does not happen in the AgNav system);
  • The right to restrict or prevent your personal data being processed;
  • The right to have your personal data ported to another data controller;
  • The right to erasure and;
  • The right to complain to the Data Protection Commission if you believe we have not handled your personal data in accordance with Data Protection legislation
